This is actually illegal in the states.

In the US it is illegal to look at the contents of packets transiting the net. Deep scanning of packets is simply not allowed. (Doesn't stop the government, but then they are our overlords and rightly above the law)
It is also illegal to send packets with forged 'from' addresses, and this is exactly what Comcast are doing. They are sending packets with the forged IP of the victims in them. Definitely illegal.

What Comcast is doing is one of the reasons why I wish where I am, that we had a choice of providers. I'm on Charter. Right across the state line is Comcast. Hmm, maybe I ought to rethink what I just said.
